Trademark Education: A Sanity Check Before You Brand
You found a promising name for your business.
The domain is available.
Your state approved the LLC.
A Google search did not reveal an obvious competitor.
Does that mean the name is safe to use?
Not necessarily.
Each of those checks answers a different question:
• A domain search tells you whether a web address is available.
• An LLC search tells you whether your state will accept the entity name.
• A Google search may reveal obvious marketplace uses.
None of them determines whether the name is clear from a trademark perspective.
That requires looking beyond exact matches. Two names may create a conflict even when they are spelled differently if they are similar in sound, appearance, meaning, or overall commercial impression—and are used for related goods or services.
For example, a proposed name may deserve closer review if:
• A similar-sounding mark is already registered
• The spelling is different, but customers would pronounce it the same way
• The earlier company sells a related product or service
• The name describes an important feature of the product
• Someone is already using a similar name without a federal registration
There are also different levels of trademark review:
A knockout search examines federal registrations and pending applications for potentially conflicting marks.
A comprehensive clearance search looks more broadly at federal and state records, business names, domains, marketplace use, and unregistered—or “common law”—uses.
An initial screening cannot guarantee that a name is available, but it can help determine whether the name appears promising or whether a more complete search is warranted before you invest in branding.
